Whistleblower Protection Act for your company

The Whistleblowing Directive has stated that companies and authorities must set up a whistleblowing system from December 2021 with a number of >250 employees and from December 2023 with a number of >50 employees.

Die Whistleblowing Policy has stated that companies and public authorities

  • from December 2021 with a number of >250 employees,
  • from December 2023 with a number of >50 employees

must set up a whistleblowing system.

What is a whistleblower system?

A whistleblower system allows employees to report breaches of rules securely and anonymously. This is, for example, an external body outside the company that can be reached by employees. They are also known as ombudspersons. Lawyers, for example, can take on this function.

background

Employees often do not dare to report to management if they have identified misconduct among other colleagues or even the company management themselves, such as buying services or goods that are too expensive. There is great fear of professional consequences.

The threats to companies are increasing more and more: industrial espionage, theft, inventory differences, etc. If it is the rule in your company that “something goes away”, this is not only annoying for you and the company's profits, but also demotivates your entire team.

Our recommendation

Train yourself and your team to act in accordance with the rules and abide by the law — in short: compliance. You should also provide your company with an ombudsperson. On the one hand, you ensure that reports from your company are handled professionally, specifically and objectively. On the other hand, your team members will no longer worry about professional consequences if you want to uncover grievances at work.
