Registered Lien for Aircraft
Similar to real estate, aircraft can also be encumbered with a registered lien. This requires notarization.
When the owner initially registers for the lien register, they must credibly demonstrate that they are the owner of the aircraft. This requires, in addition to presenting the purchase contract, an affidavit from the owner, which must be notarized.
A lien on an aircraft is created by the agreement between the owner and the creditor, as well as the registration of the lien in the register for aircraft liens. The registration authorization requires notarized signature verification. Before registration, the parties are only bound to the agreement if:
- The declaration is notarized, or
- Submitted or filed with the register court, or
- The owner has handed over a registration authorization to the creditor, which is either notarized or officially certified.
Notarial Inheritance Law
Another significant area of activity for notaries is inheritance law. This includes advising on and drafting wills and inheritance contracts, as well as handling various legal issues that arise after an inheritance case, such as applying for certificates of inheritance and managing estate distributions.
Although these topics are easy to overlook, you should not leave your inheritance to chance but take care of your affairs early on. Otherwise, statutory inheritance law will apply. This often leads to unwanted consequences.
To avoid any unpleasant surprises, you should regulate your succession through dispositions made during your lifetime. Inheritance law offers a multitude of structuring options, which your notary can advise you on.
In our considerations, we also include the possibility of lifetime transfers of assets to your spouse, your children, or other close individuals. When designing such a transfer agreement, we as notaries ensure that your rights are sufficiently secured according to your wishes.
Family Law
Our notaries are also active in the field of marriage and family law. Whether it concerns the conclusion of a marriage contract, non-marital partnerships seeking arrangements, the legal consequences of a divorce, or an intended adoption, notarial form is prescribed due to the far-reaching consequences of these declarations.
The statutory matrimonial property regime of community of accrued gains is not suitable and fair for every marriage. Sometimes there are also external constraints, often experienced by entrepreneurs, that require a modification of the matrimonial property regime. Therefore, spouses can agree on a different matrimonial property regime, such as separation of property or community of property, through a notarial marriage contract before or during their marriage. Alternatively, and usually advisable, they can modify the community of accrued gains according to their own preferences. Such agreements typically also cover provisions on maintenance and
pension rights, in addition to the matrimonial property regime.
Unmarried partners also have regulatory needs, for example, in the case of jointly financed purchases of real estate or matters concerning their common children. Should your marriage encounter a crisis and lead to separation, we provide impartial and independent advice to amicably settle the consequences of the separation and a subsequent divorce in a separation and divorce settlement agreement. In such an agreement, you can regulate all essential questions of the separation phase as well as the consequences of divorce, especially property rights adjustments and maintenance-related issues. This can significantly reduce the costs of a divorce.
Corporate Law
Running a company or establishing one poses various legal questions and aspects where competent advice is required. Therefore, many corporate law matters require notarization by law to protect legal transactions and the parties involved. Your notary assists you in preparing, notarizing, and executing various corporate law matters, such as:
- founding a company,
- choosing the appropriate legal form, and
- the sale or transfer of a company.
We support you through shareholders' meetings of a GmbH regarding amendments to the articles of association and capital increases and notarize the transformation of companies. We also handle notarization-required participation agreements for venture capital investments or strategic entries into established companies.
Real Estate Law
A focus of our daily practice lies in real estate law. This includes all form-required legal transactions concerning land and buildings, such as:
- buying and selling a single-family or multi-family home or a condominium, even if it is yet to be constructed by the developer,
- dividing a house into condominium ownership,
- extensive development projects in the residential and commercial real estate sectors,
- encumbering properties with mortgages and land charges, rights of way, residential rights, and usufruct.
We develop tailor-made solutions and find precise implementation possibilities for unconventional cases. Through balanced notarial contract drafting, we reconcile the interests of the seller and the buyer and legally secure all parties involved in the contract execution. We represent builders, project developers, buyers, developers, and brokers. With decades of experience, we understand the perspectives of both lawyers and notaries.
We know what is important in handling real estate transactions so that both financing and the necessary land charge registration can be secured quickly, and the purchase price paid out swiftly. Thanks to a broad, interdisciplinary network with strong and experienced partners, we succeed in looking beyond the obvious.
Provision & Care
At any time, illness, an accident, or old age can put a person in a situation where they can no longer manage all their affairs independently. This phase of needing help often extends over a long period and places a significant burden on supportive relatives and other close individuals. Although everyone has the opportunity to actively shape this phase through precautionary measures such as a power of
attorney and living will and thereby relieving their relatives and caregivers, this is unfortunately often neglected.
We help you make the right arrangements, provide you with notarial documents, and register these documents with the Central Register of Wills of the Federal Chamber of Notaries.
Other matters
Besides documenting activities in the described legal fields, notaries can also record documents in various other areas. Thus, a notary is responsible for notarizing:
- oaths and sworn declarations,
- acknowledgments of debt and submissions to enforcement,
- auctions and raffles,
- recordings of asset inventories,
- bills and checks protests,
- certifications of facts,
- notarization of signatures and copies.
Moreover, notaries are also tasked with supporting parties in the field of preventative legal care. This includes, in addition to drafting, advising, and representing before courts and authorities (§ 24 BNotO), especially the fiduciary custody of money and valuables. Notaries are often appointed by the decedent as executors of wills.
